Colorado Assault Laws

In Colorado, assault charges are outlined in §§18-3-201-209 of the Colorado Revised Statutes. You may be charged with a felony or misdemeanor, depending on the degree of your assault charge. First and second degree assault are charged as felonies, while third degree assault is a misdemeanor. All degrees of assault come with harsh penalties that can include significant fines and prison time.

An assault conviction may come with the following penalties:

  • First Degree Assault: up to $750,000 in fines and 24 years in jail
  • Second Degree Assault: up to $500,000 in fines and 12 years in jail
  • Third Degree Assault: up to six months in jail

Other charges categorized as assault charges include vehicular assault, menacing, criminal extortion, reckless endangerment, or assault on the elderly or persons with disabilities.

Note: Frequently, assault charges also include domestic violence ramifications. If an assault or harassment occurs between two people who have or have had an intimate relationship with each other (such as spouses or co-parents), the ramifications may include required domestic violence treatment and classes, and a Mandatory Protection Order. This may also have an impact on the outcome of any family law matters you have in process, such as custody and divorce cases.
